'Gutting' the California Public Records Act

The horror, the horror. I and other San Diego journalists began discussing potential, troublesome changes to the public records law in earnest Saturday morning with a bill headed to Gov. Jerry Brown that would take some of the teeth out of the CPRA. His budget action is expected in coming days.

Following floor votes of the state Senate and state Assembly on Friday, here are the specific provisions of the law that will be eliminated on July 1 if Brown doesn’t act:

• The requirement that governments respond to records requests within 10 days.
• The mandate that governments help members of the public — who don’t know what records are on hand — to shape a request for something tangible.
• The requirement that documents be provided in an electronic format if the government has them available that way.

The majority — Samuel Alito, John Roberts, Clarence Thomas, Stephen Breyer and Anthony Kennedy — said taking DNA swabs during arrests for serious crimes is the same as taking fingerprints or photographs.
